Court: Harrison Crouch et al vs James Huffstutter et al, 1867, Nicholas Co., Kentucky.3 There was a disagreement over the division of the farm of John Huffstutter because his will stated:

..."and be it fairly understood, that my wife and idiot son, John is to have a full and ample support out of my said plantation, stock money, etc. during their lifetime and at the death of my wife and idiot son, John, said plantation, the stock money etc. to be equally divided between my said two sons David and James."

John Sr's widow Mary died in 1866. His son John was still alive so the heirs sued to have the remainder of the estate divided.

John married Elizabeth Buskirk,4 daughter of Lewis Taylor Van Buskirk and Martha, on 28 Sep 1798 in Bourbon Co., Kentucky. Elizabeth was born before 1787 and died before 1816.

General Notes: Perry served in the Confederate Army and died at the Battle of Perryville, KY in the Civil War. He was a Private, Company C (Captain A.W. Caldwell's Company) of the 27th Tennessee Infantry.

27th Regiment, Tennessee Infantry
27th Infantry Regiment [also called 25th Regiment] was assembled at Camp Trenton, Tennessee, in September, 1861. Its 833 men were from the counties of Benton, McNairy, Obion, Henderson, Decatur, Crockett, Weakley, and Carroll. It was furnished arms at Columbus, Kentucky, then fought at Shiloh, Munfordville, and Perryville. The unit was assigned to General Maney's Brigade, Army of Tennessee, and in December, 1862, consolidated with the 1st Volunteers. It participated in many conflicts from Murfreesboro to Atlanta, endured Hood's winter operations, and ended the war in North Carolina attached to Palmer's Brigade. This regiment totalled 580 effectives in December, 1861, and lost fifty-four percent of the 350 at Shiloh and fifty-three percent of the 210 at Perryville. The 1st/27th had 83 casualties of the 457 at Murfreesboro, reported 14 killed and 75 wounded at Chickamauga, and in December, 1863, totalled 456 men and 290 arms. Only a remnant surrendered on April 26, 1865. Its commanders were Colonels Blackburn H. Brown, Alexander W. Caldwell, and Christopher H. Williams; Lieutenant Colonel William Frierson; and Majors Alexander C. Allen, Samuel T. Love, and John M. Taylor.

1st Battalion Mounted Rifles was organized in Eastern Kentucky during the winter of 1861-1862 and served in the Army of Eastern Kentucky and the Department of East Tennessee. The unit skirmished in Kentucky and Tennessee, then disbanded in August, 1863. Some of its members joined other Kentucky commands. Lieutenant Colonel Ezekiel F. Clay, and Majors Benjamin F. Bradley and Orville G. Camron were in command.

Dear Brethen,

The amount paid me by the congregation at Mitchel's last year is $28.25.
As stated to Bro Stover and others I had to borry money last year to meet my actual necessities hoping that the brethren at Palestine, Mitchel's, Wood's School and Pleasant Hill would enable me to meet my promises during the last year but each congregation haven fallen behind. I have heard no complaint of either congregation that I did not discharge my duty or that the amount agreed upon for my services was not reasonable and right. I hope the Elders will take the matter into consideration and if the brethren were unfortunate and can't pay their subscription, is it right for the preacher to be the entire loser and sufferer, if so I will try to bear it patiently and look to some other source to meet my promises. I have $55 to meet next Saturday if you can help me it will be highly appreciated. I would like to write you more concerning the cause of our Master but my home is (?) for school.
